Services
Nicole Babcock Photography provides professional photography services for couples, maternity, newborn, babies, and families throughout the state of Maryland. Services may include in-home lifestyle sessions, outdoor sessions, and studio-style sessions as agreed upon at the time of booking.
Session details, including date, time, location, and package inclusions, will be confirmed in writing prior to the scheduled session.

Booking and Retainer
A non-refundable retainer is required to secure your session date. Your session is not considered booked until the retainer is received and a signed agreement is returned.
The remaining balance is due prior to or on the date of the session, as outlined in your invoice. Failure to pay the remaining balance may result in cancellation of services.
Retainers are transferable to a rescheduled date within the same calendar year, subject to availability.

Cancellations and Rescheduling
If you need to reschedule, please provide at least 48 hours' notice. Rescheduling is subject to availability.
In the case of illness, emergency, or unsafe weather conditions, Nicole Babcock Photography reserves the right to reschedule the session to ensure the safety of all parties.
If the Client cancels entirely and does not wish to reschedule, the retainer will not be refunded.

Client Responsibilities
Clients are responsible for arriving on time and prepared for their session. Nicole Babcock Photography is not responsible for compromised coverage due to lateness, lack of cooperation from children, or interference from guests.
For newborn sessions, parents or guardians must remain present at all times to ensure the safety and comfort of the baby.
Clients are responsible for securing any necessary permits or permissions for chosen locations unless otherwise agreed upon.

Creative Control
Nicole Babcock Photography maintains full creative control over the session and final edited images. Editing style, image selection, and artistic direction are at the sole discretion of the Photographer.
RAW (unedited) images will not be delivered.

Image Delivery
Final edited images will be delivered via an online gallery within the timeframe specified in your session agreement, typically between 2–4 weeks.
Clients are responsible for downloading and backing up their images upon delivery. Online galleries may remain active for a limited time.

Copyright and Usage
All images created by Nicole Babcock Photography remain the copyrighted property of the Photographer.
Clients are granted a personal-use license to download, print, and share images for non-commercial purposes. Images may not be altered, edited, or used for commercial purposes without written permission.
Nicole Babcock Photography reserves the right to use images for portfolio display, website content, social media, marketing materials, competitions, and professional publication unless the Client submits a written request for privacy prior to the session.

Model Release
By booking a session, Clients grant Nicole Babcock Photography permission to use images for promotional purposes unless otherwise stated in writing before the session date.
Clients may request limited or full privacy, which must be agreed upon in advance.

Safety
The safety of newborns, babies, and families is the highest priority. Certain poses may be composite images created safely through editing techniques. Nicole Babcock Photography reserves the right to refuse any pose or setup deemed unsafe.
Clients agree to inform the Photographer of any medical conditions, allergies, or special needs prior to the session.

Limitation of Liability
Nicole Babcock Photography takes the utmost care in capturing and preserving images. However, in the unlikely event of equipment failure, loss of digital files, injury, or circumstances beyond control (including but not limited to acts of God, natural disasters, or illness), liability is limited to the amount paid by the Client.
Nicole Babcock Photography is not responsible for print quality, color discrepancies, or product defects from third-party printing labs not recommended by the Photographer.

Website Use
All content on this website, including text, images, graphics, and branding, is the property of Nicole Babcock Photography and may not be copied, reproduced, or distributed without written permission.
Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offense.

Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of Maryland. Any disputes arising under this agreement shall be subject to the exclusive jurisdiction of the courts located within Maryland.
